BK - 00027 PG:0314 LEE COUNTY Committed Today for a Better Tomorrow RECESSED MEETING OF THE LEE COUNTY BOARD OF COMMISSIONERS 106 HILLCREST DRIVE SANFORD, NORTH CAROLINA 27330 MARCH 23, 2015 The recessed meeting of the Board of Commissioners for the County of Lee, State of North Carolina, convened at 6 p.m. in the Commissioners' Room, First Floor, Lee County Government Center, 106 Hillcrest Drive, Sanford, North Carolina, on said date. Commissioners present when the meeting was called to order were Amy M. Dalrymple, Dr. Ricky D. Frazier, Dr. Andre Knecht, Larry "Doc" Oldham, Robert T. Reives, Timothy S. Sloan, and Kirk D. Smith. Chair Dalrymple called the meeting to order and the following business was transacted: Commissioner Frazier delivered the invocation. The pledge of allegiance was recited. Chair Dalrymple stated this was a recessed meeting from the March 16th regular meeting and therefore the only item to be reviewed and discussed was a Settlement and Release Agreement with Duke Energy for coal ash disposal off Colon Road. Ms. Dalrymple stated the Agreement was received in the County Manager's office Friday afternoon and therefore staff had not had a lot of time to study and review. County Attorney Kerry Schmid outlined major sections of the Agreement and asked the Board for direction and guidance on some sections. After discussion and suggestions were provided, Chair Dalrymple called for a 5- minute recess. Upon returning from recess, with all members present, the recessed meeting resumed. The Board agreed for the County Attorney to contact Duke Energy with the recommended changes /additions referenced before the recess. The County Attorney will keep the Board updated on responses from Duke. With no further business to come before the Board, Commissioner Frazier moved the meeting be recessed until 6 p.m., Wednesday, March 25, 2015. Upon a vote, the results were as follows:
