LEE COUNTY ENVIRONMENTAL AFFAIRS BOARD <br />Section 1.00: Authority, Purpose and Duties <br />1.01 Authority <br />Under the authority granted in Chapter 153A -76 of the North Carolina General Statutes, and <br />resolution dated March 2, 2015, the Lee County Board of Commissioners creates this Lee County <br />Environmental Affairs Board. <br />1.02 Purpose <br />The general purpose of the Environmental Affairs Board is to maintain and improve the quality <br />of the environment in Lee County. <br />1.03 Duties <br />The specific duties of the Environmental Affairs Board include: 1) advising the local governments <br />of the County of Lee, the City of Sanford, and the Town of Broadway on environmental policy; 2) <br />educating the public and local officials about environmental issues; 3) performing special studies <br />and projects on environmental questions; 4) facilitating citizen participation; 5) remaining <br />informed about changes in environmental laws and regulations affecting the County (and <br />informing the public and local officials about such changes); and 6) promoting the State /County <br />and public /private cooperation and coordination. This list is not exhaustive, and the <br />Environmental Affairs Board should construe its duties broadly. The Environmental Affairs <br />Board shall not have authority to enforce any regulations, rules, ordinances, or laws. <br />1.04 Topics <br />The Environmental Affairs Board shall consider any and all topics related to the quality of the <br />Lee County environment. Topics include, but are not limited to: coal ash and hydraulic <br />fracturing; hazardous and radioactive materials management and disposal; watershed <br />protection; groundwater and surface water protection; erosion control; air quality; energy <br />conservation; incineration; sedimentation control; storm water management; open space <br />protection; pollution prevention; waste management; and recycling. The Environmental Affairs <br />Board should use the widest latitude in determining what topics to address. <br />Section 2.00: Organization <br />2.01 Membership Composition in Terms <br />Except as provided in the following paragraphs, the Environmental Affairs Board shall be <br />comprised of eleven (11) voting members: five (5) appointed by the Lee County Board of <br />Commissioners, five (5) appointed by the Sanford City Council, and one (1) appointed by the <br />Broadway Town Council. In addition, three ex- officio, non - voting members shall serve on the <br />Environmental Affairs Board, as outlined below. <br />Initially, ten (10) voting members shall be appointed by the Lee County Board of Commissioners <br />to represent the County of Lee's jurisdiction. Such appointments shall be comprised of those <br />members of the Lee County Environmental Review and Advisory Committee ( "ERAC ") serving at <br />the time of its dissolution, and each member shall only serve the remainder of the term of their <br />ERAC appointment.
