28 <br />PROPOSED AMENDMENT 3 (Article 6, Section 6.1.7.5 Curb & Gutter and Section 6.7.3 <br />Sidewalks) Amendment to Article 6, Section 6.1.7.5 and Section 6.7.3 to require sidewalks and <br />curb & gutter within ALL subdivisions, except residential subdivision in the unincorporated <br />area of Lee County that include a minimum lot size of 30,000 square feet or greater. Current <br />language requires curb and gutter and sidewalks only within residential subdivisions with a <br />minimum lot size of less than 20,000 square feet. Below is the draft language. <br />Draft language: <br />6.7.1.5 CURB AND GUTTER. <br />6.7.1.5 New subdivisions composed shall be required to provide curb and gutter except as <br />follows: <br />Residential subdivisions located in the unincorporated area of Lee County that <br />include a minimum lot size of 30,000 square feet or greater. <br />In determining the lot size for a proposed subdivision, the following shall be considered: <br />The actual lot sizes as proposed, not the underlying zoning, shall be used in <br />determining if the subdivision will be required to provide curb and gutter. <br />For subdivisions with a range of lot sizes proposed, the average of all the lots shall <br />be calculated and used to determine if the project will be required to provide <br />sidewalks. <br />6.7.1.5.2 Specific design standards for the curb and gutter shall be obtained from the <br />respective jurisdiction's engineering department or other authorized agency. <br />6.7.3 SIDEWALKS. <br />6.7.3.1 New subdivisions composed shall be required to provide pedestrian sidewalks <br />along one side of a new public street except as follows: <br />• Residential subdivisions located in the unincorporated area of Lee County that <br />include a minimum lot size of 30,000 square feet or greater. <br />In determining the lot size for a proposed subdivision, the following shall be considered: <br />• The actual lot sizes as proposed, not the underlying zoning, shall be used in <br />determining if the subdivision will be required to provide sidewalks. <br />• For subdivisions with a range of lot sizes proposed, the average of all the lots shall <br />be calculated and used to determine if the project will be required to provide <br />sidewalks. <br />6.7.3.2 Specific design standards for sidewalks shall be obtained from the respective <br />jurisdiction's engineering department or other authorized agency. <br />10 <br />
