028 <br />• Restoration of property to condition prior to development of the solar collection facility, <br />including replacement of top soil removed or eroded and re- vegetation of any cleared <br />areas with warm season grasses that are native to the region, unless requested in writing <br />by the landowner not to re- vegetate due to plans for agricultural planting <br />• The timeframe for completion of decommissioning activities <br />• Description of any agreement (e.g. lease) with landowner regarding decommissioning <br />• The party currently responsible for decommissioning <br />• Plans for updating this decommissioning plan <br />After approval of the SUP, but prior to the final electrical inspection, the decommissioning plan <br />shall be recorded at the Lee County Register of Deeds Office and a recorded copy shall be <br />provided to staff. If the decommissioning plans are modified, a copy of the modified <br />decommissioning plan as recorded at the Lee County Register of Deeds Office shall be provided <br />to staff. In the event of a change of ownership of the facility, the new owner of the facility must <br />provide an updated signed decommissioning plan within 30 days of the change of ownership. <br />A solar collector facility that ceases to produce energy on a continuous bases for 12 months will <br />be considered abandoned unless the current responsible party (or parties) with ownership <br />interest in the facility provides substantial evidence (updated every 6 months after 12 months of <br />no energy production) to the Zoning Administrator of the intent to maintain and reinstate the <br />operation of that facility. It is the responsibility of the responsible party (or parties) to remove <br />all equipment and facilities and restore the land to its condition prior to the development of the <br />facility. <br />If the applicant ceases operation of the energy facility or begins, but does not complete, <br />construction of the project, the applicant shall restore the site according to a decommissioning <br />plan approved by the Planning & Development Dept. <br />Section 9.
