BK - 00027 PG <br />Corporation remains a publically traded corporation, Tenant shall not be required <br />to provide financial statements to Landlord. <br />23. Option to Terminate So long as Tenant is not in default in the payment of any <br />rent due under this Lease, Tenant shall have the option to terminate this Lease by <br />paying the Landlord the Termination Fee and providing Landlord 180 days prior <br />written notice of termination. As used herein "Termination Fee" shall be an <br />amount calculated by multiplying the Landlord's Cost times a fraction, the <br />denominator of which shall be the number of months in the lease term and the <br />numerator of which shall be number of months remaining in the lease term as of <br />the date of termination specified in Tenant's notice of termination. Landlord's <br />Cost shall mean the sums actually paid by Landlord in the performance of <br />Landlord's Work together with any leasing commission paid by Landlord to <br />unaffiliated third parties in connection with the Lease. The Termination Fee shall <br />be paid as of the final day of the lease as specified in Tenant's termination notice. <br />24. Compliance.
