0?�6lcf— c-�i <br />RESOLUTION <br />JOINT AGREEMENT BETWEEN THE CITY OF SANFORD AND LEE COUNTY <br />PRODUCT DEVELOPMENT INITIATIVE — LEE COUNTY INDUSTRIAL PARK <br />October 6 & 7, 2014 <br />WHEREAS, the Lee County Board of Commissioners began the development of a new section <br />of the Lee County Industrial Park in 2001; and <br />WHEREAS, in 2003 the County completed construction of the Colon Road Sewer Lift Station <br />which was designed to serve 2200 acres of potential Industrial Property and contracted with the <br />City of Sanford to maintain and service the lift station; and <br />WHEREAS, the City of Sanford purchased the Lee County water system on December 21, 2004 <br />and became the primary source for water and sewer services in the City of Sanford and Lee <br />County; and <br />WHEREAS, by divesting itself of the Colon Road Lift Station, the County will complete the transfer <br />of all water and sewer assets to the City of Sanford; and <br />WHEREAS, in August of this year, the City and County, along with the newly created Sanford <br />Lee County Partnership for Prosperity (SLCPP), agreed to co -locate the departments and <br />agencies associated with Community and Economic Development to the Buggy Factory <br />beginning in the summer/fall of 2015; and <br />WHEREAS, both the City of Sanford and Lee County wish to develop product that the new SLCPP <br />can use to recruit new industry investment and jobs to our community as part of their continued <br />cooperative effort to bring growth to the community. <br />NOW, THERFORE, BE IT RESOLVED, BY THE SANFORD CITY COUNCIL AND LEE <br />COUNTY BOARD OF COUNTY COMMISSIONERS, that it is the intent of the County <br />Commissioners to transfer ownership of the Colon Road Sewer Lift Station to the City of Sanford <br />for their use in the continued development of the Lee County Industrial Park. As part of this <br />transfer, the County agrees to use funds the City intends to pay to the County (not to exceed <br />$800,000 from the City) in consideration for the transfer to develop Broadband Infrastructure in <br />the Industrial Park by extending the current NCMC line from Central Carolina Community College <br />to CCCC facilities in the Industrial Park. Planning and development of this project will begin when <br />both bodies agree to this transfer of assets by approving this agreement. <br />BE IT FURTHER RESOLVED by both Boards that in additional consideration of the transfer of <br />the Lift Station, City Council will commit to extend water and sewer lines to the Lee County <br />Industrial Park so that sites within the Park will become more marketable as industrial sites. <br />Planning and development of water and sewer line extensions to the Park will begin when this <br />agreement is signed by both parties. <br />BE IT FURTHER RESOLIVED that by passing this Resolution, both Boards instruct their staff <br />attorneys to develop the necessary documents to complete the transfer of the Colon Road Sewer <br />Lift Station from the County to the City, and further instruct the City and County Managers to begin <br />the projects committed to in this Resolution. <br />
