B K 00026 PG <br />Lee County Environmental Review and Advisory Committee (ERAC) <br />Page 2 <br />Miscellaneous <br />• Applicants and operators should offer cuttings, logs, cores and other well information to the <br />state geological survey within 5 years of well completion. <br />• Same day reviews and inspections should be included in the rules. <br />Areas outside MEC Authority <br />The following concerns were raised by ERAC in review of the MEC Draft Rules but lie outside the <br />authority of the MEC. These concerns do impact local communities and may be more appropriately <br />addressed by the County through other avenues. <br />Emergency Responders <br />Concern: Emergency Responders need to be provided adequate training on appropriate procedures for <br />oil and gas exploration activities and be provided ample knowledge of what is present on any location to <br />which they are called. <br />Recommendations: <br />Under 15A NCAC 05H.1305: All emergency responders in areas where permits are proposed <br />shall receive Control Response Contractor training certification prior to the beginning of drilling <br />activities. This training will be provided by the State of North Carolina and the local government <br />that employs these responders will be reimbursed for all expenses associated with training. <br />• UNDER 15A NCAC 05H .2006 SAFETY AND SECURITY AT PITS AND TANKS: Any barrier should <br />have proper signage on it to warn any person approaching of the hazard, also a contact number <br />for the POC in charge of this location should be available and valid. <br />Air Quality <br />Concern: The draft does not address air quality relying on existing air quality standards and procedures. <br />DENR lacks the capacity, in staff and equipment, to effectively monitor air quality. <br />Recommendation: <br />A percentage of application fees should be set aside for air monitoring equipment and training <br />for local government staff to install, operate and maintain these stations. Information gathered <br />should be publically available. <br />Miscellaneous <br />• Applicants and operators should not be allowed, without permission, to access the surface of <br />property where they only have land agreements with subsurface owners unless that right is <br />specifically stated in the deed separating surface and subsurface rights. <br />2 <br />
