2. The Town agrees to keep records of all disaster debris removal expenses and <br />activities and to provide those to the County as necessary for the County to <br />be reimbursed by FEMA or the State of North Carolina. <br />3. The County agrees to file any necessary paperwork with FEMA and/or the <br />State of North Carolina to be reimbursed for eligible activities. <br />4. The County agrees to pay the Contractor for work conducted under their <br />"Pre -Event Contract for Disaster Debris Management Services" within the <br />Town limits. <br />5. The County delegates to the Town of Broadway all authority to direct the <br />execution of the scope of services of the contract for disaster debris <br />management services within the Town boundaries. <br />6. The Town agrees to bear any portion of the costs associated with the work <br />performed within the Town limits, which is not eligible for reimbursement by <br />FEMA, or the State of North Carolina, and agrees that the County shall bear <br />no responsibility for any cost, damage or liability arising from the services <br />performed under the "Pre -Event Contract for Disaster Debris Management <br />Services" which occurs within the Town limits. <br />7. The term of this Interlocal Agreement shall be the same as that under the <br />"Pre -Event Contract for Disaster Debris Management Services" including <br />any extensions, change orders or modifications to the term of that agreement <br />unless sooner changed hereunder. <br />8. The Town or the County may terminate this Interlocal Agreement at any time <br />for any reason by notifying the Manager of the other entity in writing. <br />9. The County shall ensure that the Contractor shall identify vehicles removing <br />debris within the Town limits as "Town of Broadway" vehicles. <br />10. The County shall ensure that Contractor supply a separate point person for <br />contact by the Town for work performed within the Town limits. <br />11. The County agrees that the temporary disaster staging sites identified for use <br />by their Contractor shall also be used for debris removed from the Town <br />limits at no charge. <br />IN WITNESS WHEREOF, and as the duly authorized act of the governing <br />bodies, the parties hereto have caused this instrument to be signed in their respective <br />names by their proper officials and to be attested by their respective Clerks the day and <br />year first above written. <br />LEE COUNTY <br />I: <br />ATTEST: <br />Charles T Parks, Chairman <br />Gaynell M.
