Suit. § I53A-27 Page 2 of 2 <br />NOTES: <br />CROSS REFERENCES. --As to counties not subject to this section, see G.S. 153A-27.1. <br />CASE NOTES <br />AUTHORITY TO ACCEPT RESIGNATION. --Under former statute which authorized the clerk of <br />the superior court to fill vacancies on boards of commissioners in all cases, it was held that a <br />tender of resignation by a county commissioner to the clerk of the superior court was a <br />tender to the proper authority. While the mere filing of the resignation did not vacate the <br />office, its acceptance by the clerk was final, and after its acceptance the commissioner had <br />no power to withdraw it. Rockingham County v.
