082 <br />L1'K COUNTY <br />PUBLIC NOTICE <br />O Notice is hereby giv- <br />en that the Lee Cowt- <br />ty Board of Adjust- <br />ment will hold public <br />hearings on Monday, <br />April 16, 2007 in the <br />upstairs courtroom of <br />the Old Courthouse <br />located at 1408 South <br />Horner Boulevard, <br />Sanford, NC for the <br />purpose of consider- <br />ing an application for <br />a Special Use Permit <br />and an application <br />for a Variance for the <br />Special Use. The <br />hearing will begin at <br />7:00 p.m. or as soon <br />thereafter as deemed <br />practical by the <br />Board. <br />0 <br />L_IJ <br />1. Application by the <br />North Carolina State <br />Highway Patrol to ob- <br />tain a Special Use <br />Permit for the con- <br />struction of a 385 <br />emergency manage- <br />ment tower on the <br />property of Central <br />Carolina Community <br />College located at <br />3000 Airport Road, <br />Sanford, NC. The tow- <br />er will be used for the <br />implementation of <br />the Voice Interopera- <br />bility Plan for Emer- <br />gency Responders <br />(VIPER) system for <br />public safety agencies <br />in North Carolina in <br />accordance with the <br />North Carolina State <br />Homeland Security <br />Strategy. The proper- <br />ty is the same as de- <br />picted on Lee County <br />Tax Map 9641.03 and <br />9641.04, Tax Parcel <br />9641-52-2700, Lee <br />County Land Re- <br />cords. <br />2. Application by the <br />North Carolina State <br />Highway Patrol for <br />zoning Variances <br />from the Unified De- <br />velopment - Draft <br />trance, Article 5.33.2.3 <br />(c) Minimum Setback <br />Requirements for tel- <br />ecommunication tow- <br />ers that are more <br />than 75 feet high and <br />located adjacent to <br />property which is res- <br />identially and none <br />residentially zoned or <br />used. The applicant <br />is requesting the fol- <br />lowing variances for <br />placement of the 385' <br />telecommunications <br />tower requested in <br />i item r; l above. 'f he <br />requh-ed residential <br />setback is 770 feet (2 <br />times hejght 0. <br />tower) <br />and the required non- <br />residential setback is <br />285 feet (minimum 50 <br />feet plus one foot for, <br />every foot of tower <br />height over 150 feet). <br />Variance #l. Setback <br />from Property zoned, <br />residential: <br />(a). a front setback <br />variance of 87 feet <br />(b). a side setback <br />variance of 79 feet, <br />and (c). a rear setback <br />variance of M7.75 <br />feet Variance# 2. Set- <br />back front property <br />zoned non-residen- <br />tial: a rear setback <br />variance of 189.90 <br />feet, and Variance #3. <br />Landscaping Require- <br />ments: a variance to <br />remove landscaping <br />on the non-residen- <br />tial side of the tower <br />compound. The prop- <br />erty is located at 3000 <br />Airport Road, San- <br />ford, NC and owned <br />by the Central Caroli- <br />na Community Col- <br />lege.
