2. DIVISION OF RENTAL EXPENSES. Parties agree that each entity shall pay the lease expenses <br />according to the terms of the lease, as described on Attachment A. <br />3. DIVISION OF UTILITY EXPENSES. City and County shall each pay one half (1/2) of the cost of <br />utilities attributable to the occupancy of the building by city and county departments. SLPP shall be <br />responsible for its own utility costs. <br />4. EQUIPMENT AND FURNISHINGS. City and County shall be responsible for furnishing the offices of <br />their respective departments. Furnishings for conference rooms and open areas shared by all Tenants <br />shall be paid for by mutual agreement of the County of Lee, City of Sanford and SLPP, except for those <br />areas of the building not covered under the lease. <br />5. INFORMATION TECHNOLOGY. City and County shall be responsible for the telephone and internet <br />service fees associated with their respective departments. <br />6. INSURANCE. City and County shall, at their own expense throughout the term of the lease, maintain <br />fire and extended coverage insurance for furniture, supplies and equipment. Both City and County shall <br />maintain public liability insurance including bodily injury and property damage and commercial liability <br />insurance on the premises. Both City and County shall provide Landlord with a Certificate of Insurance <br />naming Landlord as an additional insured and providing a ten -day written notice to Landlord in the event <br />of cancellation or material change of coverage. <br />EXISTING INTERLOCAL AGREEMENTS. All existing Interlocal agreements for the involved shared <br />departments shall remain in full force and effect, except as they address rental payments and utility <br />expenses which are modified above. <br />8. TERMINATION. In additional to the method of termination provided in paragraph 1, either party may <br />terminate this agreement upon six (6) months' written notice to the other party. <br />Notice shall be given: <br />as to the City of Sanford: City Manager <br />P.O. Box 3729 <br />Sanford, NC 27331 -3729 <br />as to the County of Lee: County Manager <br />P.O. Box 1968 <br />Sanford, NC 27331 -1968 <br />9. EFFECTIVE DATE. This agreement shall be effective upon its adoption by the majority vote of the <br />members of the governing board of the County and City and its due execution by the proper officials of <br />each unit of government. The minutes of each unit of government shall record the action taken in <br />accordance herewith. <br />10. AMENDMENTS. Upon mutual consent in writing, this agreement may be amended by the parties at <br />any time for any reason. <br />
