6 i- "�' <br />STATE OF NORTH CAROLINA ) <br />COUNTY OF LEE ) <br />INTERLOCAL AGREEMENT <br />FOR SHARED USE OF THE BUGGY <br />FACTORY <br />THIS AGREEMENT, made and entered into this _ day of , 2014, by and between the <br />County of Lee, one of the counties of the State of North Carolina and a body both politic and corporate, <br />hereinafter referred to as "County ", and the City of Sanford, a municipal corporation chartered by the State <br />of North Carolina, hereinafter referred to as "City "; <br />WITNESSETH: <br />THAT WHEREAS, the County and City desire to jointly lease the property located at 115 Chatham <br />Street (hereinafter "the Buggy Factory ") for purposes of locating various city and county departments and <br />agencies; and, <br />WHEREAS, the City and County will or have entered into a Lease Agreement with Bryan Bystry, <br />Progressive Development Co. LLC, for the lease of the Buggy Factory to City, County and Sanford -Lee <br />County Partnership for Prosperity; and, <br />WHEREAS, it is the intent of the parties to increase efficiencies and effectiveness of all aspects of <br />development for Sanford and Lee County by co- locating the Community Development, Planning, Building <br />Inspections, Code Enforcement, Downtown Sanford, Inc., Strategic Services (GIS), Environmental Health, <br />Marketing and Sanford -Lee County Partnership for Prosperity (Chamber of Commerce and Economic <br />Development) departments within the Buggy Factory; and <br />WHEREAS, Progressive Development Co, Inc., Landlord, has agreed to make improvements to <br />renovate the Buggy Factory to accommodate the City and County occupancy; and <br />WHEREAS, by action of the Lee County Board of Commissioners and the Sanford City Council, the <br />parties hereto have indicated their intent concerning the locating of various city and county departments and <br />the Sanford -Lee County Partnership for Prosperity at the Buggy Factory. <br />NOW, THEREFORE, for and in the consideration of the payment hereinafter mentioned, the mutual <br />promises herein contained and the mutual benefits to result therefrom, and pursuant to the provisions of <br />Chapter 160A and Chapter 153A of the North Carolina General Statutes, the County and City agree as <br />follows: <br />1. TERM. The term of this Interlocal Agreement shall be for one (1) year beginning upon execution and <br />ending October 1, 2015, and shall be renewed automatically thereafter for additional one (1) year terms, <br />subject to the Parties making appropriations in keeping with the agreed upon funding. If the parties do <br />not appropriate funding on the agreed upon basis, then the contract shall be extended until June 30 of the <br />last fiscal year for which appropriations were made and the City and County shall pay compensation to <br />Landlord pursuant to the terms of the Lease Agreement attached hereto as Exhibit A. At the end of that <br />period, this Agreement shall automatically terminate. <br />
