<br />THIS DEED OF EASEMENT dated this day of ,
<br />2014 between COUNTY OF LEE (hereinafter called "Grantor"), and the City of
<br />Sanford, a municipal corporation located in Lee County, State of North Carolina
<br />(hereinafter called "Grantee ").
<br />THAT WHEREAS, Grantor is the owner of a tract of land situated in the
<br />City of Sanford, East Sanford Township, Lee County, North Carolina, which is
<br />described in a certain deed recorded in Book 246 Page 537 Book 1113 Page
<br />236 Book 1113 Page 224 Lee County Registry; and
<br />WHEREAS, Grantee has requested and Grantors have agreed to grant to
<br />the Grantee a variable width permanent sidewalk, utility and pedestrian ingress
<br />and egress easement, and for ongoing maintenance, ingress, egress, and
<br />regress to said sidewalk as shown on the map attached as Exhibit A & B, over
<br />the lands of Grantor for the installation of sidewalk, utilities and a variable width
<br />temporary construction easement as shown on attached Exhibit A & b to
<br />construct said sidewalk and/or utilities on said land;
<br />NOW, THEREFORE, Grantor, in consideration of the sum of one ($1.00)
<br />dollar and other valuable consideration, in hand paid by Grantee, the receipt and
<br />sufficiency of which is hereby acknowledged, do hereby give, grant, sell, and
<br />convey to Grantee, its successors and assigns, a variable width permanent
<br />easement for the inspection, operation, maintenance, repair and use of said
<br />sidewalk and utilities; said easement "Exhibit A & B ".
<br />Said variable width temporary construction easement is conveyed, as
<br />shown on Exhibit A and shall terminate thirty (30) days after the completion of the
<br />installation of the sidewalk.
<br />SAID EASEMENT is to be used and enjoyed by the Grantee, City of
<br />Sanford, its successors and assigns, and the public, to keep up, construct, repair,
<br />operate, maintain and use said sidewalk or utilities, and use the same so far as
<br />may be necessary, for said purpose with right of ingress and egress, by the
<br />public, thereto thereon at all times. The City of Sanford shall have the right to cut
<br />and remove such trees and growth in, upon, and along said sidewalk as may
<br />interfere with the installation, laying, upkeep, and maintenance of said sidewalk
<br />for the purpose herein stated.
