v:2 3 <br />(f) Tenant shall not deliberately or negligently destroy, deface, damage or remove any <br />part of the Premises (including all facilities, appliances, and fixtures) or permit any <br />person, known or unknown to Tenant, to do so. <br />22. Non - Appropriations Clause. Notwithstanding any other provision of this Lease, the <br />Tenant shall not be obligated for performance hereunder or by any provision of this <br />Lease during any of the Tenant's future fiscal years unless and until the governing bodies <br />of both the City and the County appropriate funds for this Lease in the Budget for each <br />such future fiscal year. In the event that funds are not appropriated for this Lease by <br />either or both Tenant, then this Contract shall terminate as =e 30 of the last fiscal <br />year for which funds were appropriated. The Tenant shall notify the Landlord in writing of <br />any such non - allocation of funds at the earliest possible date:.° <br />23. Improvements. Landlord will lease the property based on prd�,ing the agreed upon <br />tenant improvements represented by the finalized design floor ph r Improvements to <br />include all construction work required build outtenant improvements a, ,general building <br />improvements necessary to meet local ar> t -C building codes. Landlord shall make a <br />good faith effort to ensure that all renovations are energy-efficient, including using an <br />energy efficient design in all systems, including but- of limited to heating, cooling, <br />plumbing and electrical systems, etc.` <br />24. Complete Agreement. The Lease is intended by the parties as a final and complete <br />expression of their agreement and as an exclusive statement of the terms thereof. <br />25. Riders and Exhibits.
