BK - 00026 PG:0670 <br />ARTICLE 33 <br />NON - EXCLUSIVE CONTRACT <br />This Contract shall be non - exclusive and the County may procure the services contemplated <br />hereby from other sources at the County's discretion. <br />ARTICLE 34 <br />CONTRACT LANGUAGE <br />Use of the masculine includes feminine and neuter, singular includes plural, and captions and <br />headings are inserted for convenience of reference and do not define, describe, extend or limit <br />the scope or intent of this Contract. <br />ARTICLE 35 <br />INCORPORATION OF CONTRACT DOCUMENTS <br />The Contract between County and Contractor shall consist of this document and all exhibits <br />referenced herein, the Request for Proposal and the Contractors' Response to the Request for <br />Proposal. If the documents are in conflict, the order of precedence shall be as follows: Non - <br />Exclusive Contract for Disaster Debris Management Services with Exhibits, Request for <br />Proposals for Disaster Debris Management and Removal Services, then the Contractor's <br />Response to the Request for Proposals. <br />ARTICLE 36 <br />AMENDMENTS <br />This Contract may not be amended except by written instrument duly executed by or on behalf <br />of all of the parties hereto. <br />ARTICLE 36 <br />ARBITRATION <br />Any controversy or claim arising out of, or relating to this Contract, or its breach, shall be <br />settled by arbitration in Lee County, North Carolina in accordance with the provisions of the <br />North Carolina Revised Uniform Arbitration Act, (the "Act "). The parties to this Contract <br />understand that this arbitration provision shall expressly apply to this Contract in accordance <br />with the Act. Judgment upon the award rendered may be entered and enforced in any court of <br />competent jurisdiction. <br />ARTICLE 38 <br />NOTICES <br />All formal notices, requests or reports required hereunder shall be in writing and sent to the <br />Point of Contact for both parties as outlined below: <br />Page <br />23 <br />
