BOOK ti3 PAGF 99 <br />M <br />(e) The Contractor agrees to comply with such guidelines as the College, the <br />State, or USDOL may issue to implement the requirements of the Act. <br />(d) The Contractor shall designate a person other than its chief executive as its <br />equal employment opportunity officer, who shall be responsible for the <br />Contractor's non-discrimination policy, monitoring the equal employment <br />opportunity compliance, development of a procedure for investigation of <br />an hearings on equal employment opportunity grievances, dissemination <br />of non-discrimination policy for the Contractor, and evaluation of the <br />Contractor's proposal for adverse EEO effects and liaison with the <br />College. <br />24. Non-Discrimination <br />The College is committed to promoting equal opportunities for all and to <br />eliminating prohibited discrimination in all forms. For purposes of this section, <br />prohibited discrimination means discrimination in the solicitation, selection, and / <br />or treatment of any subcontractor, vendor, supplier or commercial customer on <br />the basis of race, ethnicity, gender, age, religion, national origin, disability or <br />other unlawful form of discrimination. Without limiting the foregoing, prohibited <br />discrimination also includes retaliating against any person, business or other <br />entity for reporting any incident of prohibited discrimination. It is understood and <br />agreed that not only is prohibited discrimination improper for legal and moral <br />reasons, prohibited discrimination is also an anti-competitive practice that tends to <br />increase the cost of goods and services to the College and others. As a condition <br />of entering into this Agreement, the Contractor represents warrants and agrees <br />that it does not and will not engage in or condone prohibited discrimination. <br />Without limiting any rights the College may have at law or under any other <br />provision of this Agreement, it is understood and agreed that a violation of this <br />provision constitutes grounds for the College to terminate this Agreement. <br />As a condition of entering into this Agreement, the Contractor further agrees to <br />promptly provide to the College all information and documentation that may be <br />requested by the College from time to time regarding the solicitation and selection <br />of subcontractors. Failure to maintain or failure to provide such information <br />constitutes grounds for the College to terminate or withhold payment under this <br />Agreement. <br />25. Nepotism <br />The Contractor agrees for itself and its subcontractors that no two members of an <br />immediate family shall be employed within the same agency if such employment <br />will result in one supervising a member of his immediate family, or in one <br />occupying a position which has influence over the other's employment, <br />promotion, salary administration, and other related management or personnel <br />Page 9of16 <br />
