The Agency is mandated by law to perform various functions and to provide various services within the community including, but not limited to, investigation of and intervention in child abuse, neglect, and dependency. The Attorney shall be available, upon reasonable notice, for consultation, legal advice, and representation as requested by the Agency on legal services arising from providing these various functions and services as aforesaid. 7. The Attorney agrees to comply with all statutory requirements of the North Carolina General Statutes, regulations, policies and practices adopted or promulgated regarding the performance of program legal services. These requirements include, but are not limited to, maintaining such records as are required by the County or Agency, making such records available for federal and state audit if required, and making any financial, statistical, and program progress reports. 8. The County agrees to pay the Attorney for the provision of legal attorney services as defined in Section 2b.1 of the Social Services Fiscal Manual a copy of which is attached hereto and by this reference, made a part hereof, for time spent in performing the services required under this contract at the following rates per hour: ninety five dollars per hour for in -court trial time; ninety five dollars per hour for in -court waiting time (ratio of private contracted); and ninety five dollars per hour for out -of -court time. These hourly rates shall encompass all expenditures including, but not limited to, those for salary, supplies, office space, heating and maintenance for office space, telephone service, long - distance telephone calls, and travel. The Attorney is not to be reimbursed for incurring extraordinary expenses incident to performing the services required under this contract, with the exception that the County agrees to pay all court costs and filing fees, which are required to be paid in conjunction with the services performed by the Attorney under this contract. A rate of $45 per hour (not to exceed $360 per day) will be paid for Administrative Attorney Services (defined as the activities engaged in by an attorney, which are outside the realm of legal services as defined in the preceding paragraph). Specifically, this category would include attendance at professional meetings, seminars, administrative support, and the like. 9. The Attorney shall submit to the Agency reports of expenditures by the first working day of the month following the month during which the services and/or expenditures were incurred. 10. Brenda B. Potts is designated the Contract Administrator for the County with responsibility for all matters concerning this contract, including, but not limited to, invoice approval.
