BK :00026 PG:0581 <br />STATE OF NORTH CAROLINA ) <br />CONTRACT FOR PURCHASE OF <br />LEGAL SERVICES <br />(PRIMARY ATTORNEY for Child Support) <br />COUNTY OF LEE ) <br />THIS CONTRACT is for the purchase of legal services by and between the <br />COUNTY OF LEE, one of the counties of the State of North Carolina and a body both <br />politic and corporate, hereinafter referred to as "County ", and Tron Faulk, Attorney at <br />Lawyer referred to as "Attorney ", to provide for the legal services needed by the Lee <br />County Department of Social Services, hereinafter referred to as "Agency;" <br />WITNESSETH: <br />WHEREAS, the County desires to contract with the Attorney to provide legal services <br />needed by the Agency upon the following terms: <br />1. This contract shall begin July 1, 2014 and will continue through June 30, <br />2015, unless sooner terminated as provided herein. <br />2. The Agency is mandated by law to perform various functions and to <br />provide various services within the community including, but not limited to, <br />establishment and enforcement of child support. The Attorney shall be available, upon <br />reasonable notice, for consultation, legal advise, and representation as requested by the <br />Agency on legal services arising from providing these various functions and services as <br />aforesaid (Article 9, Chapter 110 of the North Carolina General Statutes, Title 42 United <br />States Code, Section 651 et s ., and the regulations promulgated thereunder) <br />3. The Attorney agrees to comply with all statutory requirements of Article 9, <br />Chapter 110 of the North Carolina General Statutes, Title 42 United States Code, Section <br />651 et sect and the regulations, policies and practices adopted or promulgated regarding <br />the performance of program legal services. These requirements include, but are not <br />limited to, maintaining such records as are required by the County or Agency, making <br />such records available for federal and state audit if required, and making any financial, <br />statistical, and program progress reports. <br />4. The Department agrees to pay the Attorney $105 per hour for the provision <br />of legal attorney services as defined in Section 2b.1 of the Social Services Fiscal Manual <br />a copy of which is attached hereto and by this reference, made a part hereof, for time spent <br />in performing the services required under this contract at the following rates per hour: one <br />hundred five dollars per hour for in -court trial time; one hundred five dollars per hour for <br />in -court waiting time (ratio of private contracted); and one hundred five dollars per hour <br />for out -of -court time. These hourly rates shall encompass all expenditures including, but <br />not limited to, those for salary, supplies, office space, heating and maintenance for office <br />space, telephone service, long- distance telephone calls, and travel. The Attorney is not to <br />be reimbursed for incurring extraordinary expenses incident to performing the services <br />
