WHEREAS, all immunities provided by law shall be full applicable as stated in North Carolina <br />General Statute 166A -19.60 <br />NOW, THEREFORE, in consideration of the terms, conditions, and covenants expressed herein, <br />the parties agree as follows: <br />1. The Counties of Wake and Lee shall participate in a coordinated sharing of resources for the <br />purposes of providing protection of the community; <br />2. During a Rapidly Escalating Event Alert at the Harris Nuclear Power Plant, for the purposes of <br />Public Notification and Protective Action Decisions (PADS), Lee County, through this Agreement, <br />authorizes Automatic Mutual Aid from Wake County to activate warning sirens and issue <br />Emergency Alert System messages on behalf of Lee County prior to establishing contact or <br />concurrence with Lee County; <br />3. If necessary, requests for additional resources will be jointly coordinated by the Emergency <br />Management Agencies of Wake and Lee Counties to other governmental entities, private sector <br />agencies, and State Division of Emergency Management; <br />4. It is mutually understood that each party's foremost responsibility is to its own citizens. The <br />provisions of this document shall not be construed to impose an unconditional obligation on any <br />party to this agreement to provide aid and assistance pursuant to a request from another party. <br />Accordingly, when contacted by the recipient /local agency, provider's authorized representative <br />shall assess provider's own local situation in order to determine available personnel, equipment <br />and other resources prior to deployment of resources; <br />S. Unless otherwise agreed to by the Recipient and Provider, the Recipient shall pay to the <br />Provider all documented costs and expenses incurred by the Provider as a result of extending <br />aid and assistance; <br />a. Personnel- During the period of assistance, Provider shall continue to pay its employees <br />according to its then prevailing ordinances, rules and regulations. Recipient shall <br />reimburse Provider for all direct and indirect payroll costs and expenses, including but <br />not limited to travel and employee retirement benefits as provided by Generally <br />Accepted Accounting Principles. However, Recipient shall not be responsible for <br />reimbursing any amounts paid or due as benefits to Provider's personnel under the <br />terms of the North Carolina Workers' Compensation Act. <br />b. Equipment- Provider shall be reimbursed by Recipient for the use of its equipment <br />according to local, state or federal hourly rates or according to the actual replacement, <br />operation and maintenance expenses incurred. <br />c. Materials and Supplies- Provider shall be reimbursed by Recipient, for all materials and <br />supplies furnished, used or damaged during the period of assistance, except for the <br />costs of equipment, fuel and maintenance materials, labor and supplies, which shall be <br />included in the equipment rate above, unless such damage is caused by gross <br />negligence, willful and wanton misconduct, intentional misuse, or recklessness of <br />Provider's personnel. <br />6. This Agreement shall be binding upon Wake County and Lee County in perpetuity, unless <br />terminated upon at least ninety (90) days advance written notice by one party to this <br />Agreement to each executive officer of every other participating entity. <br />
