(4 <br />omission of any proposer to examine any form, instrument, or document shall in no way <br />relieve any proposer from any obligation in respect of his proposal. <br />The County may make such investigations as he deems necessary to determine the ability <br />of the proposer to perform the work, and the proposer shall furnish to the County all such <br />information and data for this purpose as the County may request. The County reserves the <br />right to reject any proposal if the evidence submitted by, or investigation of, such <br />proposer fails to satisfy the County that such proposer is properly qualified to carry out <br />the obligations of the contract and to complete the work contemplated therein. <br />Conditional proposals will not be accepted. <br />5.6 CONDITIONS OF WORK <br />Each proposer must inform himself fully of the conditions relating to the construction of <br />the project and the employment of labor thereon. Failure to do so will not relieve a <br />successful proposer of his obligation to furnish all material and labor necessary to carry <br />out the provisions of his contract. Insofar, as possible contractor(s), in carrying out his <br />work, must employ such methods or means as will not cause any interruptions of or <br />interference with the work of any other contractor(s). <br />5.7 LAWS AND REGULATIONS <br />The proposer's attention is directed to the fact that all applicable state laws, municipal <br />ordinances, and the rules and regulations of all authorities having jurisdiction over <br />construction of the project shall apply to the contract throughout, and they will be <br />deemed to be included in the contract the same as though herein written out in full. <br />5.8 FORCE MAJEURE <br />It is mutually understood and agreed that the contract holder shall be waived of its <br />obligations under the contract during any period or periods of time when acts of God, war <br />or public enemy render impossible its performance under the contract. In such case, the <br />contract holder shall give the County prompt oral notification followed by written notice <br />of the particulars and estimated duration of said Force Majeure. <br />5.9 SERVICES <br />Proposer must review the Scope of Services attached hereto and provide support for the <br />fact that it has sufficient experience and expertise as is necessary to ensure that all <br />charges incurred by the County with respect to Contractor's Services hereunder are <br />eligible for reimbursement by FEMA. <br />5.10 PAYMENT TO CONTRACTOR <br />A. Contractor shall be paid for the Services rendered and accepted in accordance <br />with the unit prices specified in the "Contractor's Price Proposal" attached hereto for <br />Page 14 <br />
