U <br />4 t� <br />SECTION 5 <br />TERMS & CONDITIONS <br />5.1 METHOD OF AWARD <br />The County recognizes that, because this RFP is issued in connection with the possibility <br />of a future disaster event, and because any contract awarded would be on a line item basis <br />for multiple types of disaster - related work, it is impossible to determine with certainty <br />which proposer's prices would ultimately result in the lowest cost to the County. <br />Evaluation will therefore be based on the criteria stated in the RFP, with price being the <br />foremost, but not the exclusive, award criterion. <br />The best proposal submitted by a responsible proposer will be negotiated with the <br />County. If proposal amounts exceed the available funds to finance the contract, the <br />County may reject all proposals or may award the contract on a negotiated proposal with <br />deductible alternates applied in numerical order in which they are listed on the Form of <br />Proposal, as produces a net amount, which is within the available funds. <br />The County reserves the right to waive any informalities or technical errors that in its <br />judgment will best serve the interests of the County. <br />5.2 TERM OF CONTRACT <br />The contract resulting from this RFP shall be for a base period of three (3) years with an <br />option to renew for up to two additional one (1) year periods, upon consent of all parties. <br />This contract shall only be used on an "as needed" basis as determined solely by the <br />County. <br />5.3 SUBCONTRACTS <br />The successful proposer shall be prepared to furnish a general list of all subcontractors <br />that it intends to utilize for the project, and shall endeavor to utilize local subcontractors <br />whenever possible, provided that these local contractors hold proper license and <br />insurance credentials for the intended work. <br />5.4 FUNDING OUT CLAUSE <br />In the event of a disaster, County may elect to remove debris with County forces, to <br />activate a contract resulting from this RFP, or contract separately for debris removal. <br />5.5 QUALIFICATIONS OF PROPOSER <br />At the time of the opening of proposals, each proposer will be presumed to be thoroughly <br />familiar with the plans and contract documents (including all addenda).
