800 8 Sabi-710 <br />RESOLUTION OF THE LEE COUNTY BOARD OF COMMISSIONERS CONCERNING <br />UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION <br />POLICY ACT OF 1970. <br />WHEREAS, the Board of Commissioners for Lee County has <br />heretofore determined it to be in the public interest to participate <br />in the Community Development Program; and <br />WHEREAS, the Board of Commissioners desires to establish <br />standards and policies for relocation assistance and real property <br />acquisition to be followed in those areas delineated in the Com- <br />munity Development Block Grant Program; and <br />WHEREAS, Lee County presently has in operation Community <br />Development Program No. B-75-DN-37-0009 and Community Development <br />Program No. B-76-DN-37-0023; <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />1. That all relocation and real property acquisitions <br />carried out in the aforesaid projects shall comply with Article 2, <br />"Relocation Assistance" of Chapter 133 "Public works" of the General <br />Statutes of North Carolina, and with Sections 210 and 305 of the <br />Federal Act entitled "The Uniform Relocation Assistance and Real <br />Property Acquisition Policies Act of 1970," approved January 2, 1971, <br />(Public Law 91-646, 91st Cong., S.1, 84 Stat. 1894) <br />2. That all relocation and real property acquisitions <br />carried out in the aforesaid projects shall also conform to the <br />following standards, notwithstanding any provisions set forth in any <br />application, contract, or agreement for the aforesaid projects, namely: <br />(a) That fair and reasonable relocation payments and <br />assistance shall be provided in accordance with <br />Sections 202, 203, and 204 of the Act and applicable <br />HUD regulations, to or for families, individuals, <br />partnerships, corporations or associations displaced <br />as a result of the above mentioned projects. <br />(b) That relocation assistance programs offering the services <br />described in Section 205 of the Act shall be provided <br />to such displaced families, individuals, partnerships, <br />corporations or associations in the manner provided <br />under applicable HUD regulations. <br />
