r <br />STAFF REPORT PRESENTED AT THE PUBLIC HEARING <br />WITH A RECOMMENDATION FROM THE PLANNING BOARD <br />• FOR A CHANGE TO THE OFFICIAL ZONING MAP OF LEE COUNTY <br />APPLICATION 2009-0702 <br />RECOMMENDATION OF THE PLANNING BOARD: The Planning Board by a majority <br />vote recommends that the Board of Commissioners approve Application 92009-0702 as <br />submitted by Randall Godfrey to rezone .93+-acres of land at 2915 Tramway Road from <br />Residential Agricultural (RA) district to Highway Commercial (HC) district. <br />It was the consensus of the Board that the lot was already developed with a commercial building <br />and the Greenwood Small Area Plan recommends highway commercial for this area. <br />Upon a vote, the results were as follows: <br />Aye: Chairman Jaime Teel, Vice Chairman Lee Littiken, Joe Johnson, Greg Smith and <br />Rev. Herman Morris <br />Nay: Roy Cox <br />LAND USE INFORMATION PRESENTED AT THE PUBLIC HEARING: <br />Site and Area Description <br />is The petitioned lot is located on the south side of Tramway Road, beginning at the southeast <br />corner of the intersection of Tramway Road and Bruce Coggins Road. The lot is .927-acres in <br />size and is currently developed with a commercial building that was formerly Tramway Supply <br />Company (feed and tack store). The lot has 305.32' feet of road front on Tramway Road and <br />165:59' feet of frontage on Bruce Coggins Road. <br />Utilities <br />Public water and a private on-site septic system currently exist on the lot. <br />Existing Zoning and Land Uses <br />All adjoining properties are zoned for residential uses. The primary land uses surrounding the <br />site are low-density single family dwellings and farmland. Several industrial uses exists <br />approximately 1,200 east of the subject lot. Commercial uses in the area are concentrated along <br />US Highway 1, approximately 2,800 feet from the subject site. <br />Staff Analysis <br />The subject property was developed in 2001 as a feed supply store. Prior to the adoption of the <br />Unified Development Ordinance (UDO), farm supplies sales was a permitted use in the <br />Residential Agricultural zoning district. The use has been operating under a nonconforming <br />(grandfathered) land use status since the adoption of the UDO in 2006. The Farm Supply Store <br />recently ceased its use. When a non-conforming use is discontinued for a consecutive period of <br />180 days, only a conforming use may occupy the site.
