~c <br />® ORDINANCE NO. 0-2006-22 <br />ORDINANCE PROHIBITING GRAFFITI AND <br />CERTAIN POSSESSION OF GRAFFITI IMPLEMENTS <br />WHEREAS, The Town of Kernersville has in recent years experienced an increase in <br />vandalism of both public and private property as a result of the placement of graffiti on <br />buildings, walls, structures and other surfaces within the Town; and <br />WHEREAS, the Kernersville Police Department has requested that the Town Board <br />consider enacting local ordinances that will assist them in their efforts to prevent the nuisance <br />and destructive effects of graffiti; and <br />WHEREAS, the Board of Aldermen has reviewed the programs of many municipalities <br />to determine which aspects and programs might be most useful to the Town and determined that <br />persons who engage in such activity generally do so at certain locations and during certain times <br />such that reasonable restrictions on possession of graffiti implements on or near those places and <br />during those times will likely serve to help reduce the amount of vandalism of this nature in the <br />Town. <br />NOW, THEREFORE, BE IT HEREBY ORDAINED by the Board of Aldermen of the <br />Town of Kernersville that Chapter 11 of the Code of Ordinances is amended by adding the <br />is following: <br />"Sec. 11-16. Graffiti. <br />(a) Graffiti prohibited. It shall be unlawful for any person to write, paint, inscribe, scratch, <br />scrawl, spray, place or draw graffiti of any type on any public or private building, structure or <br />any other real or personal property. <br />(b) Definitions: <br />(1) Graffiti implement means an aerosol paint container, a broad-tipped marker or paint <br />stick capable of scarring or leaving a visible mark on any natural or man-made surface. <br />(2) Graffiti means any unauthorized inscription, word, figure, painting or other <br />defacement that is written, marked, etched, scratched, sprayed, drawn, painted, or engraved on or <br />otherwise affixed to any surface of public or private property by any graffiti implement, to the <br />extent that the graffiti was not authorized in advance by the owner occupant of the property, or, <br />despite advance authorization, is otherwise deemed a public nuisance by the Town Council. <br />(3) Aerosol paint container means any aerosol container that is adapted or made for the <br />purpose of applying spray paint or other substances capable of defacing property. <br />(4) Broad-tipped marker means any felt tip indelible marker or similar implement with a <br />flat or angled writing surface that, at its broadest width, is greater than one-fourth (1/4`h) of an <br />inch, containing ink or other pigmented liquid that is not water soluble. <br />
