~c ® ORDINANCE NO. 0-2006-22 ORDINANCE PROHIBITING GRAFFITI AND CERTAIN POSSESSION OF GRAFFITI IMPLEMENTS WHEREAS, The Town of Kernersville has in recent years experienced an increase in vandalism of both public and private property as a result of the placement of graffiti on buildings, walls, structures and other surfaces within the Town; and WHEREAS, the Kernersville Police Department has requested that the Town Board consider enacting local ordinances that will assist them in their efforts to prevent the nuisance and destructive effects of graffiti; and WHEREAS, the Board of Aldermen has reviewed the programs of many municipalities to determine which aspects and programs might be most useful to the Town and determined that persons who engage in such activity generally do so at certain locations and during certain times such that reasonable restrictions on possession of graffiti implements on or near those places and during those times will likely serve to help reduce the amount of vandalism of this nature in the Town. NOW, THEREFORE, BE IT HEREBY ORDAINED by the Board of Aldermen of the Town of Kernersville that Chapter 11 of the Code of Ordinances is amended by adding the is following: "Sec. 11-16. Graffiti. (a) Graffiti prohibited. It shall be unlawful for any person to write, paint, inscribe, scratch, scrawl, spray, place or draw graffiti of any type on any public or private building, structure or any other real or personal property. (b) Definitions: (1) Graffiti implement means an aerosol paint container, a broad-tipped marker or paint stick capable of scarring or leaving a visible mark on any natural or man-made surface. (2) Graffiti means any unauthorized inscription, word, figure, painting or other defacement that is written, marked, etched, scratched, sprayed, drawn, painted, or engraved on or otherwise affixed to any surface of public or private property by any graffiti implement, to the extent that the graffiti was not authorized in advance by the owner occupant of the property, or, despite advance authorization, is otherwise deemed a public nuisance by the Town Council. (3) Aerosol paint container means any aerosol container that is adapted or made for the purpose of applying spray paint or other substances capable of defacing property. (4) Broad-tipped marker means any felt tip indelible marker or similar implement with a flat or angled writing surface that, at its broadest width, is greater than one-fourth (1/4`h) of an inch, containing ink or other pigmented liquid that is not water soluble.
