019 <br />6~ S9I4~ <br />MEMORANDUM CAS0 <br />TO: Lee County Board of Commissioners <br />Lee County Planning Board <br />John Crumpton, County Manager <br />FROM: Marshall Downey, Assistant Director of Planning and Development <br />DATE: March 24, 2009 <br />REF: Public Hearing regarding four (4) amendments to the Unified Development <br />Ordinance (UDO) <br />Amendment I - Consideration of a text amendment to the Unified Development Ordinance <br />(UDO) to create a new residential design standards overlay zoning district. <br />Recently, a Council member from the Sanford City Council requested that an overlay zoning <br />district be created that could be applied to his ward in order to implement regulations on <br />residential fencing requirements. In the recent past, the Sanford City Council has had some <br />ongoing discussion about residential fencing requirements; however, there has never been a <br />consensus as to what appropriate standards should be applied for the entire City. As such, this <br />Councilmcmber then asked for support for the creation of fencing standards that would be <br />applied only to his ward. <br />Planning staff recommended that the easiest way to accomplish this would be through the <br />creation of an overlay zoning district that could be applied to specific areas. If this overlay <br />district were adopted, the City would then have to conduct a second step which is to rezone <br />the official zoning map to include this new overlay district within the desired ward. Please <br />note that this overlay zoning district is being crafted such that it could be applied to other <br />residential areas/wards in Sanford, Broadway or Lee County, if so desired. Additionally, it <br />could be expanded to include design standards other than fencing. <br />The Joint Planning Commission voted unanimously in favor of moving forward with this <br />proposed amendment.
