3 <br />based upon the percentage of all funds allocated to each of the member units <br />• for the program fiscal year during which the disallowed funds were disbursed <br />4. Nothing contained in this Article VI shall be interpreted so as to prohibit the <br />member units (or any of them) from seeking contribution or indemnification <br />from any subrecipient, service provider, contractor or from any other such <br />responsible person or entity. <br />5. The member units shall contractually be held harmless by the program service <br />providers from liabilities arising out of activities by the said providers under <br />WIA. In addition, each such provider will be required in its contract for services <br />to maintain a faithful performance blanket bond and liability insurance coverage <br />(or similar such coverage), which bond to the extent possible under prevailing <br />insurance practices, shall name the member units as additional insureds. <br />& Any entity or joint agency created or designated by this Local Workforce <br />Investment Area, including the Workforce Development Board, and <br />Administrative Entity, shall be considered a public agency for the purposes of <br />the Local Government Budget and Fiscal Control Act. <br />ARTICLE VII. ESTABLISHMENT OF A WORKFORCE DEVELOPMENT BOARD <br />The member units of government agree that the Workforce Development Board shall be <br />established in accordance with the State of North Carolina Executive Order 90 <br />(December, 1996), Section 102 of the Job Training Partnership Act, and Section 117 of <br />the Workforce Investment Act. <br />The Chairpersons of the Boards of Commissioners of the undersigned units of local <br />government shall appoint members of the Workforce Development Board from among <br />persons nominated or recommended by appropriate agencies representative of any <br />member county and in accordance with the Job Training Partnership and Workforce <br />Investment Acts. Each county in the Consortium shall have an equal number of <br />members on the Board. <br />ARTICLE VIII. APPOINTMENT OF PERSONNEL <br />The agreement between the Mid-Carolina Service Delivery Area and Mid-Carolina <br />Workforce Development Board states the agency that will be responsible for planning, <br />the agency that will be the grant recipient for WIA funds within the local area and that <br />agency will administer the programs under the Workforce Investment Act. Included as <br />part of this Consortium Agreement, as Exhibit A, is the Agreement Between the Mid- <br />Carolina Local Workforce Investment Area and Mid-Carolina Workforce Development <br />Board. <br />ARTICLE IX. OWNERSHIP OF REAL PROPERTY <br />The Mid-Carolina Workforce Development Consortium will neither acquire nor dispose of <br />real property. <br />0 ARTICLE X. AMENDMENTS <br />
