BOOK 23 PdGF 98 <br />resident commissioner, or employee of the United States Government shall be <br />entitled to any share or part of this contract or any benefits to arise herefrom. <br />21. Contractor Personnel <br />The Contractor represents that it has, or will secure at its own expense, all <br />personnel required in performing the services under this contract. Such personnel <br />shall not be employees of the College during any time within the twelve- (12) <br />month period immediately prior to the date of this contract. The Contractor must <br />submit to the College a listing of personnel involved in performing the services <br />under this contract. Changes in the approved listing of Contractor staff personnel <br />shall require written notification to the College prior to the change. <br />22. Maintenance of Effort <br />Contractor sponsored training in existence prior to the initiation of this contract <br />shall be continued and may not be reduced in any way as a result of this contract <br />(except for reduction unrelated to the provisions or purposes of this contract). <br />The Contractor agrees that implementation of this contract will not result in the <br />displacement of employed workers or impair existing contracts for services or <br />result in the substitution of Federal or other funds in connection with work that <br />would otherwise be performed. <br />23. Equal Employment Opportunity <br />(a) "fhe Contractor shall not discriminate, as prescribed in Section 188 of the <br />Act or as prohibited under state law, against any employee, applicant for <br />employment, applicant for WIA activities. WIA participant, or <br />subcontractor because of race, color, disability, religion, age; sex, or <br />national origin. Such action shall include, but not be limited to the <br />following: employment, upgrading, demotions, or transfers; recruitment or <br />recruitment advertising; layoffs, or termination; rates of pay, or other <br />forms of compensation; selection for training including apprenticeship; <br />participation in recreational and educational activities; or any WIA <br />activities. The Contractor certifies that it presently has in effect such an <br />affirmative action program. The Contractor agrees to post in a <br />conspicuous place available to employees and applicants for employment <br />notices setting forth the provisions of this non-discrimination clause. <br />The Contractor shall in all solicitations or advertisements for <br />subcontractors or employees placed by or on behalf of the Contractor, <br />state that the Contractor is an "Equal Opportunity Employer". <br />(h) The Contractor shall keep such records and submit such reports <br />concerning characteristics of applicants for employment and employees as <br />the College, the State, and USDOL may require. <br />Page 8 of 16 <br />
