BOOK 23 PaGF 97 <br />18. Drug Free Workplace <br />The Contractor will provide a drug free workplace as set forth in Attachment E. <br />19. Lobbying Certification and Disclosure Requirements <br />The Contractor, as a recipient of Federal contracts, grants, and loans, is prohibited <br />from using appropriate funds to lobby the Executive or Legislative Branches of <br />the Federal Government in connection with a specific contract, grant, or loan, in <br />accordance with USDOL codified common rule 29 CFR Part 93. The Contractor <br />must file a disclosure report if lobbying activity, using other than Federal <br />appropriated funds, has occurred for the covered action. <br />The Contractor shall complete and submit to the College a "Certification <br />Regarding Lobbying" document if the total compensation to be paid to the <br />Contractor under paragraph 4 (Compensation and Method of Payment) of this <br />contract exceeds $100,000. The certification should be made available for review <br />during oversight and reviews and audits. <br />The Contractor shall complete and submit to the College a "Disclosure Form to <br />Report Lobbying" (Attachment F) if the total compensation to be paid to the <br />Contractor under this contract exceeds $100,000 and uses non-Federal funds to <br />lobby for the covered Federal action. <br />19. Non-procurement Debarment and Suspension Requirements <br />The Contractor, as a recipient of Federal contracts, grants, and loans, is prohibited <br />from doing non-procurement business with any person suspended or barred by <br />any other Federal agency, in accordance with USDOL codified common rule 29 <br />CFR Part 98. Non-procurement business includes grants, cooperative agreements, <br />scholarships, fellowships, contracts of assistance, loans, loan guarantees, <br />subsidies, insurance, payments for specified use, donation agreement and any <br />other non-procurement transactions between a Federally-funded agency and a <br />"person". A person is any individual, corporation, partnership, association, and <br />unit of government or legal entity. <br />The Contractor certifies, by signing this contract, that neither it nor its principals <br />are presently debarred, suspended, proposed for debarment, declared ineligible or <br />voluntarily excluded from participation in this contract by any Federal department <br />or agency. Where the Contractor is unable to certify to any of the aforementioned <br />certification statements, the Contractor shall submit to the College a written <br />explanation with this contract. <br />20.
