61'7 <br />`F cou <br />• V' m.., Ty <br />*I, <br />O.q~,~ ~1Ze <br />MEMORANDUM H CA, <br />TO: Lee County Board of Commissioners <br />John Crumpton, County Manager <br />s <br />FROM: Marshall Downey, Assistant Director of Community Development <br />DATE: January 20, 2009 <br />REF: Consideration of adoption of an amendment to the Unified Development <br />Ordinance (UDO) to create new regulations for concessionaire vendors. <br />Members of the Board may recall that at the October 20, 2008 meeting a public <br />hearing was conducted regarding new rules for "concessionaire" vendors. These proposed <br />rules were reviewed and, after some changes, approved by the Planning Boards for all three <br />jurisdictions. <br />As you may recall from the public hearing, the new language seeks to add 1) a <br />definition for a "concessionaire" vendor and 2) to add language to exempt these <br />concessionaires from the 10-day time limit as set forth in Section 5.34.2.2. <br />The Planning Boards also recommended the following additional conditions: (a) limit <br />the distance that a vendor may be located from the entrance of the supporting business to 50 <br />feet, (b) making sure that appropriate ingress/egress is maintained, and (c) placing a limit on <br />the size of vending carts/trailers to be used. <br />The draft amendment is attached 66r your consideration of adoption. <br />0 <br />
