G. <br />_ Information <br />XX Action Item <br />Consent Agenda <br />SUBJECT Consider Offer to Purchase Property Located on Stroud Street <br />DEPARTMENT Administration <br />CONTACT PERSON John Crumpton, County Manager <br />REQUEST Consider an offer from Cameron and Darlene Francis for the purchase of property located <br />on Stroud Street in the City of Sanford, and require the Offeror to deposit five percent (5 %) <br />of the bid with the county clerk plus $90 for advertising costs, and direct county staff to <br />publish notice of the offer. <br />SUMMARY Cameron and Darlene Francis have submitted an offer of $2,700 to purchase the property <br />located on Stroud Street, Lots 1 -10 Block E of Gunter Forest, in the City of Sanford, NC. <br />Disposition of property is governed by N.C.G.S. §153A -176 and §160A -269: "When an offer <br />is made and the [County Board] proposes to accept it, the [County Board] shall require the <br />offeror to deposit five percent (5 %) of his bid with the [county] clerk, and shall publish a <br />notice of the offer. The notice shall contain a general description of the property, the amount <br />and terms of the offer, and a notice that within 10 days any person may raise the bid by not <br />less than ten percent (10 %) of the first one thousand dollars ($1,000) and five percent (5 %) <br />of the remainder. When a bid is raised, the bidder shall deposit with the [county] clerk five <br />percent (5 %) of the increased bid, and the clerk shall re- advertise the offer at the increased <br />bid. This procedure shall be repeated until no further qualifying upset bids are received, at <br />which time the [Board] may accept the offer and sell the property to the highest bidder. The <br />[Board] may at any time reject any and all offers." <br />If the County Board proposes to accept the above - referenced offer, the next step will be to <br />publish notice of the offer for upset bids. Please note that, because the property is jointly <br />owned by both the County and the City, final approval of the offer is contingent upon <br />approval and acceptance of the offer by the City of Sanford. <br />BUDGET IMPACT The property is currently owned by the County of Lee and the City of Sanford as the result <br />of a foreclosure. Acceptance of the above mentioned offer will cover the taxes and legal <br />fees owed on the property. <br />ATTACHMENT(S) 1) Letter from Cameron and Darlene Francis, 2) Map of property, and 3) Resolution <br />PUBLIC HEARING No <br />PRIOR BOARD ACTION: N/A <br />RECOMMENDATION Accept the offer from Cameron and Darlene Francis and advertise for upset bids pursuant <br />to N.C.G.S. §160A -269. Because the property is jointly owned by the County and City, final <br />approval of the offer is contingent upon approval and acceptance of such by the City of <br />Sanford. <br />
