G. _ Information XX Action Item Consent Agenda SUBJECT Consider Offer to Purchase Property Located on Stroud Street DEPARTMENT Administration CONTACT PERSON John Crumpton, County Manager REQUEST Consider an offer from Cameron and Darlene Francis for the purchase of property located on Stroud Street in the City of Sanford, and require the Offeror to deposit five percent (5 %) of the bid with the county clerk plus $90 for advertising costs, and direct county staff to publish notice of the offer. SUMMARY Cameron and Darlene Francis have submitted an offer of $2,700 to purchase the property located on Stroud Street, Lots 1 -10 Block E of Gunter Forest, in the City of Sanford, NC. Disposition of property is governed by N.C.G.S. §153A -176 and §160A -269: "When an offer is made and the [County Board] proposes to accept it, the [County Board] shall require the offeror to deposit five percent (5 %) of his bid with the [county] clerk, and shall publish a notice of the offer. The notice shall contain a general description of the property, the amount and terms of the offer, and a notice that within 10 days any person may raise the bid by not less than ten percent (10 %) of the first one thousand dollars ($1,000) and five percent (5 %) of the remainder. When a bid is raised, the bidder shall deposit with the [county] clerk five percent (5 %) of the increased bid, and the clerk shall re- advertise the offer at the increased bid. This procedure shall be repeated until no further qualifying upset bids are received, at which time the [Board] may accept the offer and sell the property to the highest bidder. The [Board] may at any time reject any and all offers." If the County Board proposes to accept the above - referenced offer, the next step will be to publish notice of the offer for upset bids. Please note that, because the property is jointly owned by both the County and the City, final approval of the offer is contingent upon approval and acceptance of the offer by the City of Sanford. BUDGET IMPACT The property is currently owned by the County of Lee and the City of Sanford as the result of a foreclosure. Acceptance of the above mentioned offer will cover the taxes and legal fees owed on the property. ATTACHMENT(S) 1) Letter from Cameron and Darlene Francis, 2) Map of property, and 3) Resolution PUBLIC HEARING No PRIOR BOARD ACTION: N/A RECOMMENDATION Accept the offer from Cameron and Darlene Francis and advertise for upset bids pursuant to N.C.G.S. §160A -269. Because the property is jointly owned by the County and City, final approval of the offer is contingent upon approval and acceptance of such by the City of Sanford.
