Mr. Melvin J. Trumble, III, Vice-President of Trumble-McGuirk <br />and Associates (TMA), appeared before the Board and requested the following <br />exceptions and/or clarifications to its contract with the Company for re-appraisal <br />of the property: <br />1. Exception - Page 7, Section 11: Record Cards - It is agreed by <br />both parties that index cards will not be included as a part of this contract. <br />2. Clarification - The Company will utilize existing County mapping <br />records as the basis for the reappraisal; however, where possible, will utilize the <br />new reconciled mapping records. <br />3. The Company will be allowed to utilize locally hired personnel in <br />the field, provided they are properly supervised and their applications are discussed <br />with the Tax Supervisor. <br />4. The Company will be responsible for no more than 10 man.weeks <br />of informal hearings, under Section 12, Page 8, Support of Values. <br />5. The document entitled Bid Proposal for Lee County, North <br />Carolina, will be attached and made a part of the contract documents. <br />6. It is agreed that under Section 6, Page 5, Liquidated Damages, <br />the clause. but the Company shall not be responsible for compensatory nor <br />consequential damages in connection with performance of this contract", shall <br />be included. <br />After discussion and review, upon motion of Commissioner Rhyne, <br />seconded by Commissioner Franklin D. Wicker, which motion was unanimously <br />adopted,. it was RESOLVED to approve items 1 through 5 and Mr. Trumble was <br />invited to further define the limits of liability requested in Item 6 for consideration <br />by the Board. <br />Ms. Leann Sparks, Vocational Rehabilitation Counselor for Lee <br />County, appeared before the Board and reported on the operation of the Vocational <br />Rehabilitation Program in Lee County. <br />Commissioner Gordon A. Wicker moved that the Board conduct a <br />public hearing on the proposed Flood Plain Ordinance. Commissioner Franklin <br />D. Wicker seconded the motion and upon a vote it was unanimously adopted. <br />The Chairman invited all those present to state their views concerning the proposed <br />Ordinance. Mr. Jerry Almond, Member of the County Planning Board was recognized <br />and he reviewed the activities of the County Planning Board in preparation of the <br />Ordinance. Ms. Miriam Bailey, employee of the Soil Conservation Service was <br />recognized and she was advised that her agency's function was purely that of consul- <br />tation and not enforcement. After all persons had been given an opportunity to express <br />their views, Commissioner Gordon A. Wicker moved that the public hearing be <br />closed. Commissioner Clyde J. Rhyne• seconded the motion and upon a vote it was <br />unanimously adopted. <br />Mr. Melvin J. Trumble, III, re}-=-appeared before the Board and <br />requested that Section 6, page 5, of the Specifications entitled "Liquidated Damages" <br />be amended by adding a clause to read as follows: but the Company shall not be <br />responsible for such damage, loss or injury as does not flow directly and immediately <br />from performance of the company. " Commissioner Rhyne moved the specifications <br />be amended as requested by Mr. Trumble. Commissioner Franklin D. Wicker <br />seconded the motion and upon a vote it was unanimously adopted. <br />
