0 BOOK 9 1AGE 30 <br />days after first consideration by the planning board. <br />First consideration shall be at the next regularly sched- <br />uled meetirg of the planning board that follows at least <br />fourteen (14) days after the plat is submitted. Before <br />the planning board takes final action on the plat, the <br />building inspector shall refer copies of teh plat and any <br />accompanying material to those public officials and agen- <br />cies concerned with new development, including, but not <br />limited to, the building inspector,.Lee County Health <br />Department, Lee County School Board, the district engineer <br />ofthe North Carolina State Highway Commission (four copies), <br />and the appropriate county soil conservation service office <br />for review and recommendation. It is also recommended that <br />the county should refer copies to a consulting engineer <br />or Sanford's engineer. <br />If the plat is approved, approval shall be noted in the <br />planning board's minutes and should be submitted to the <br />county commissioners for approval. If the preliminary plat <br />is disapproved, the planning board's minutes shall specify <br />the reasons for such action in writing. One (1) copy of <br />such reasons shall be retained by the planning board, one <br />(1) copy of such reasons shall be given to the subdivider <br />and one (1) copy shall be given to the Lee County Clerk of <br />Court. If the preliminary plat is disapproved, the subdivider <br />may make the recommended changes and submit a revised prelim- <br />inary plat. For failure to approve or disapprove, see <br />Article VII, B.l.c. <br />3. Final Plat <br />a. Improvements Installation or Guarantees. Upon approvel of <br />the preliminary plat by the county commissioners, the sub- <br />divider may proceed with the preparation of the final plat, <br />and the installation or arrangement for required improvements <br />in accordance with the approved preliminary plat and the <br />requirements of this ordinance. <br />Prior to approval of a final plat, the subdivider shall <br />have installed improvements specified in this ordinance <br />or guaranteed their installation as provided. <br />b. Performance Guarantee. In lieu of prior construction of <br />the improvements required by this ordinance the county map, <br />for the purpose of approving a final plat, accept a guaran- <br />tee from the subdivider that such improvements will be car- <br />ried cut according to the cotmty's specifications at his ex- <br />pense. Such guarantee may be in the fora of a surety bond <br />made by a surety company licensed to do business in North <br />Carolina or certified check drawn in favor of the county, or <br />cash deposited with the county, or a letter of credit from a <br />local bank. Such guarantee shall be in an amount of not less <br />than 100% nor more than 125% of the estimated cost of the con- <br />struction of the required improvements. This amount shall be <br />determined by the chairman of the county commissioners. Per- <br />formance guarantees shall run for a period of one year and may <br />-19- <br />
