RECOMMENDATION OF THE PLANNING BOARD (► , <br />FOR A CHANGE TO THE OFFICIAL ZONING MAP OF LEE COUNTY <br />APPLICATION 2013 -1201 <br />The Planning Board by a unanimous vote recommends the Board of Commissioners approve <br />Application 42013 -1201 submitted by Mr. & Mrs. Quinton Thomas to rezone a 2 -acre lot located <br />west of NC Highway 87 South that lies between 5636 and 5740 NC Highway 87 South from <br />Residential Restricted (RR) district to Residential Agricultural (RA) district. <br />LAND USE INFORMATION PRESENTED AT THE PUBLIC HEARING <br />Site and Area Description: The property requested for rezoning consists of a 2 -acre vacant lot <br />located west of NC Highway 87 South. The lot lies between 5363 and 5740 NC Highway 87 S and <br />has 50 feet of road frontage. <br />Existing Zoning and Land Uses: Properties adjoining west of the petitioned lot and being west of <br />an abandoned railroad right -of -way is zoned Residential Agricultural. Properties adjoining north and <br />south are zoned Residential Restricted. Also to the north is a lot zoned Highway Commercial. Land <br />uses in the area consist of residential single- family homes and agricultural uses. The applicant and <br />their family own a 63+ -acre tract surrounding the subject lot. Carolina Trace Subdivision is located <br />east of the site and east of Highway 87 South. <br />Staff Analysis: On November 7 Mr. and Mrs. Thomas came into the Environmental Health <br />Services Office and Planning Office to inquire about placing a single -wide manufactured home on <br />the subject lot for their son. Upon review of their proposal, planning staff informed them that the lot <br />was zoned Residential Restricted (RR) and that manufactured homes were not allowed in the RR <br />district. The applicants stated to staff that they wanted to place the home on the lot for their son to <br />live in, to have him closer to them to help with his disabled father. After a general discussion with <br />staff, Mr. & Mrs. Thomas decided to file an application to rezone the lot to Residential Agricultural <br />(RA) district to allow for the manufactured home. With the layout of the lot, any home place on it <br />will be over 300 feet from the highway. <br />The Residential Restricted (RR) district is intended for low- density single - family residential uses and <br />housing types that only include site -built or modular homes on a 30,000sf lot. Manufactured homes <br />are not allowed in the RR zoning district. The Residential Agricultural (RA) district is intended <br />for agricultural uses and single - family housing types that allow manufactured homes as well as <br />the site built and modular homes on a 40,000sf lot. <br />Utilities: A well and septic system are currently located on the lot. The septic system has been re- <br />evaluated and approved by the Environmental Health Service Department. <br />Emergency Response: The subject property is located within the Carolina Trace Fire District. <br />Transportation: The 2012 NCDOT Traffic Count Study reported 21,000 vehicle trips per day on <br />NC Highway 87S. <br />Conformance with the 2020 Land Use Plan: The subject lot is located along a major highway <br />corridor. The 2020 Land Use Plan designates properties along this corridor within a Highway <br />Overlay for retail /commercial projects. Residential uses will continue in the area until a <br />concentration of businesses is proposed. When considering the zoning of the property, current <br />development trends of the neighborhood should be continued and applied. <br />
