Standards for approval of a <br />variance were particularly targeted for update under this new law and as such the new criteria <br />language is set forth in 3.7.4.1. Section 3.7.4.3 is of note in that the new law still requires <br />approval of a variance to obtain a 4/5"' majority vote (the only one of the three quasi-judicial <br />hearings to remain so). <br />Section 3.8 addresses procedures for appeals of staff decisions regarding land use issues and <br />regulatory approvals /denials. This section contains a substantial amount of new language that <br />the prior State Law did not provide as much detail. The language provides greater clarity to <br />who can appeal (and the timetable under which an appeal is valid), as well as procedural rules <br />as to how to process such an appeal. <br />2 <br />
