<br />RESOLUTION APPROVING THIRD UPSET BID FOR THE SALE
<br />OF PROPERTY LOCATED AT 309 W. MAIN STREET IN THE CITY OF SANFORD
<br />WHEREAS, the County of Lee owns certain property located at 309 W. Main Street, Sanford, N.C.,
<br />as shown on a deed recorded in Deed Book 113, Page 552 in the office of the Register of Deeds for Lee
<br />County, to which the record thereof, reference is hereby made for more complete description; and,
<br />WHEREAS, North Carolina General Statutes §§ 153A -176 and 160A -269 permit the county to sell
<br />property by upset bid, after receipt of an offer to purchase the property; and,
<br />WHEREAS, the County received an original offer submitted by Mary Dangerfield, on behalf of
<br />MacAdell & Associates, Inc. and WXKL 1290 AM Radio (hereinafter collectively referred to as "Ms.
<br />Dangerfield"), to purchase the property described above in the amount of $65,000; and,
<br />WHEREAS, Ms. Dangerfield paid to the County Clerk the required five percent (5 %) deposit on its
<br />offer plus advertising costs; and,
<br />WHEREAS, the Lee County Board of Commissioners accepted Ms. Dangerfield's offer of $65,000 at
<br />the Board's regular meeting on October 7, 2013, and such offer was advertised in the Sanford Herald on
<br />October 10, 2013; and,
<br />WHEREAS, Jonesboro Heights Baptist Church submitted a first upset bid offer in the amount of
<br />$68,300 and paid to the County Clerk the required five percent (5 %) deposit plus advertising costs; and,
<br />WHEREAS, the Lee County Board of Commissioners accepted this first upset bid offer from
<br />Jonesboro Heights Baptist Church at its regular meeting on October 21, 2013, and such offer was published in
<br />the Sanford Herald on October 25, 2013; and,
<br />WHEREAS, Ms. Dangerfield submitted a second upset bid offer in the amount of $72,000 and paid to
<br />the County Clerk the required five percent (5 %) deposit plus advertising costs; and,
<br />WHEREAS, the Lee County Board of Commissioners accepted this second upset bid offer from Ms.
<br />Dangerfield at its regular meeting on November 4, 2013, and such offer was published in the Sanford Herald
<br />on November 8, 2013; and,
<br />WHEREAS, on November 12, 2013, the Jonesboro Heights Baptist Church submitted a third upset
<br />bid offer in the amount of $75,650.00 and paid to the County Clerk the required five percent (5 %) deposit
<br />plus advertising; and,
<br />WHEREAS, the Lee County Board of Commissioners accepts this third upset bid of $75,650.00 from
<br />Jonesboro Heights Baptist Church, or any higher, upsetting bid, subject to the upset bid procedure.
