(63 <br />Pg. 2 of <br />PB REC 2013 -0802 <br />of permitted uses and/or (b) impose higher level design standards than that which exists within an <br />equivalent general use zoning district. Conditional Zoning District Type 2 would also be practical in <br />situations where a petitioner desires to install or construct additional buffers or other physical <br />features that would serve to increase the protection afforded neighboring properties and/or the <br />appearance of the proposed development The application shall include a Site Plan and detailed <br />narrative text that specifies the conditions that will govern the development and use of the property. <br />If approved, only the uses as listed in the application would be allowed and the site would be <br />required to be developed in accordance with the design illustrated on the site plan. Any conditions <br />proposed by the applicants and approved by the Boards shall be perpetually binding upon the <br />property included in the Conditional Zoning District unless changed or amended. <br />R -6 -C Rezoning Conditions Proposed by the Applicants <br />In addition to the general development standards required in the Unified Development Ordinance, <br />the applicants proposes the following Conditions to the Rezoning Request: <br />R -6 -C Rezoning Conditions <br />1. The Applicant will dedicate a forty-foot greenway trail easement within the buffer along <br />the Deep River for the Deep River State Trail. <br />2. The Applicant will reserve for a period of at least ten (10) years from the date of the rezoning <br />approval an undeveloped area, of at least 15 acres on the north portion of the Property and <br />along the Deep River as shown on the Concept Plan, for dedication to a public entity to be <br />used as a public park. The landowner shall provide access to the reserved property in either <br />of the following two ways, in its discretion: If the landowner constructs internal public <br />streets on the Property near to the reserved property within the reservation period, a street <br />may be located and stubbed out in such a way as to provide access to the reserved property, <br />or, alternatively, if the reserved property is purchased prior to the construction by the <br />landowner of a public street to the reserved property, the landowner may, at the time of <br />purchase, provide a right -of -way or access easement for the construction of a public street to <br />the reserved property, if requested by the public entity purchasing the property. <br />3. A planting yard buffer fifty -feet wide shall be preserved or provided along the property line <br />on the east side of the Property immediate adjacent to the other occupied residential <br />properties along that property line, and plantings within such yard shall comply with Section <br />7.5.4 of the UDO. Existing vegetation may be used to satisfy planting requirements in <br />accordance with Section 7.5.4.3 of the UDO. <br />4. No building footprint will be located within seventy -five feet of the property line on the east <br />side of the Property immediate adjacent to the other residential properties along that <br />property line. <br />5. A detailed site plan will be provided to the County, for approval, prior to development of <br />the property or any part thereof. <br />6. A 200 -foot wide buffer shall be maintained on the Property adjacent to the Deep River in <br />which no buildings may be constructed, but which may be partially cleared for utilities, <br />pedestrian access, greenways, and passive recreation facilities. <br />
