RECOMMENDATION OF THE PLANNING BOARD <br />WITH STAFF REPORT SUBMITTED AT THE AUGUST 19, 2013 PUBLIC HEARING <br />APPLICATION 2013 -0801 <br />RECOMMENDATION OF THE PLANNING BOARD <br />The Planning Board unanimously recommended approval of Application No. 2013 -0801 <br />submitted by the Village of Cumnock, LLC to rezone Lee Co. Tax Parcels 9625 -93- 7261 -00 and <br />9635 -02- 2844 -00 (a total of 53.63± acres) from Residential Restricted (RR) district to Multi - <br />Family-12 (MF --12) district. <br />STAFF REPORT SUBMITTED AT THE PUBLIC HEARING: <br />Site and Area Description <br />The site requested for rezoning consists of two (2) tracts of land whose total area equals <br />53.63facres. Both tracts are vacant with limited natural vegetation. The properties lie south of <br />Cotten Road and east of Cumnock Road. The tracts combined has over 1,400 feet of road <br />frontage on Cotten Road, an NCDOT maintained street. <br />Existing Zoning and Land Use <br />Zoning surrounding the site is Residential Restricted (RR) and Residential Agricultural (RA) <br />district. The land uses in the area consists of low- density single family home sites and several <br />large undeveloped tracts of land. The land immediately north of the subject property is owned <br />by the applicants and is currently vacant. A Planned Unit Development (PUD) rezoning request <br />has been filed on that property and will be considered concurrently herewith this request. <br />Staff Analysis <br />The applicants are requesting to rezone to a Multi- Family -12 district that could allow the <br />development of up to 648 multi- family residential units (12U /AC) on the subject property. The <br />multi - family uses may be in the form of apartments, townhomes, duplexes or single - family <br />detached homes. Multi - family development in the MF -12 district will be required to meet <br />designed standards as prescribed in the Unified Development Ordinance. <br />The Residential Restricted (RR) district is established to provide areas for low- density single - <br />family uses, with a maximum of one and one -half (1.5) dwelling units per acre. The dimensional <br />standards include a minimum lot size of 30,000 square feet, with front and rear yard setbacks of <br />30 feet, and a side yard setback of 15 feet. <br />The requested MF -12 zoning district permits multi- family uses with a maximum density of up to <br />12 units per acre, depending on unit size. A MF -12 district designation may be applied to a use <br />in a residential neighborhood that contains a mixture of single family and multi - family uses or in <br />an area for which limited density multi - family use is appropriate. A MF -12 district may be used <br />as a transition between a single family and higher intensity uses. MF -12 districts are appropriate <br />in areas containing a variety of dwelling types, or in single - family areas at the intersection of <br />local roads and collector or higher order streets. MF -12 districts are appropriate in locations <br />where affordable housing is needed. MF -12 districts shall be designated only in areas with <br />public water and sewer. <br />
